What is this settlement about?

Tuft & Needle agreed to a $3 million settlement of Emily Chebul v. Tuft & Needle, LLC in San Diego Superior Court. The lawsuit alleges Tuft & Needle deceptively advertised discounts on tuftandneedle.com, in violation of California consumer protection laws (with claims for breach of contract, breach of warranty, misrepresentation, and unjust enrichment). Tuft & Needle denies all allegations and any wrongdoing, and settled to avoid the time, expense, and risk of trial. Eligible class members receive a refund equal to 45% of the discount advertised on their purchases — about $75 per mattress on average across ~40,147 purchases.

Who's excluded: Excluded are Tuft & Needle employees, officers, and directors, and anyone who signed a separate legal release with Tuft & Needle. If you canceled or were refunded for all of your orders, you don't qualify.
