What is this settlement about?
A settlement was reached in Glenn Shoemaker v. Menard Inc., Disston Company and Gino Development (Circuit Court of Jackson County, Missouri). The lawsuit alleges the defendants failed to adequately disclose the expiration-date code on Menard-branded PERFORMAX and MASTERFORCE bonded abrasive wheels. The bond material in these grinding/cutting wheels can degrade over time — especially in humidity — and a wheel spinning at high RPM that has lost bond strength can crack apart, a safety hazard. The maximum funding obligation is $775,000 (up to $500K cash and up to $275K in replacement-wheel value). The defendants deny liability and will also start adding a 'Use by'/'EXP' date to the wheels and updating product literature and the Menards website to explain the date code.
Who's excluded: Excluded are the defendants' employees, government entities, and the assigned judge and the judge's immediate family.
