Mercedes-Benz BlueTEC Diesel Emissions (AEM) Class Action Settlement
Last reviewed Jun 18, 2026 · details verified against the official settlement notice.
Who qualifies?
Current and former owners/lessees of eligible 2009–2016 Mercedes-Benz BlueTEC or Freightliner Sprinter BlueTEC II diesels who have the Approved Emissions Modification (AEM) installed between Aug 1, 2023 and Aug 31, 2026 and file a claim by Sep 30, 2026. Nationwide — not limited by state.
- Own/lease (or formerly owned/leased) an eligible 2009–2016 BlueTEC or Sprinter BlueTEC II diesel model
- Have the AEM installed by an authorized dealer between Aug 1, 2023 and Aug 31, 2026
- Submit proof of ownership/lease (title, bill of sale, or lease) plus the final repair order by Sep 30, 2026
What is this settlement about?
The Mercedes-Benz AEM Incentive Program is the consumer-relief track of two related diesel-emissions settlements: a 2021 federal settlement (DOJ, EPA, California) requiring Mercedes to offer an Approved Emissions Modification at no cost, and a December 2025 multistate settlement ($149,673,750) with a coalition of 50 state attorneys general over the affected BlueTEC diesels. Without the modification, affected BlueTEC and Sprinter BlueTEC II vehicles are alleged to emit nitrogen oxides above legal limits during normal driving. The program (administered by Epiq at MBAEMIncentive.com) covers roughly 39,565 still-unrepaired vehicles and pays $2,000 per vehicle once the AEM is installed. Mercedes denies wrongdoing.
Who's excluded: Not eligible if the AEM was installed before August 1, 2023, or if a $2,000 incentive was already paid for the same vehicle under a prior program. This is distinct from the separate Hazdovac Mercedes emissions-parts-warranty case for newer, mostly gas-engine vehicles.
How much can you get?
$2,000 incentive payment
Paid once per Subject Vehicle after a valid claim, on top of the free install and extended warranty. Eligibility is not tied to your state of residence.
Free AEM software installation
An authorized Mercedes-Benz / Freightliner Sprinter dealer installs the emissions modification at no cost — Mercedes pays parts and labor.
Extended Modification Warranty
After installation, Mercedes provides an extended warranty covering certain components related to the modification, beyond the standard warranty.
