What is this settlement about?

A $9 million settlement resolves Todd v. Ashley Furniture Industries, LLC in the Western District of Wisconsin. It names Ashley Furniture, Ashley Global Retail, and Resident Home LLC — the parent of the Nectar, DreamCloud, and Siena Sleep direct-to-consumer brands (many buyers don't realize the four brands share ownership). The plaintiffs alleged the mattresses used fiberglass as a fire-retardant in the inner sock without adequately warning consumers. Because the outer covers are zippered, consumers removed them for laundering, exposing the fiberglass and releasing glass shards into homes — with remediation sometimes costing thousands. Who's excluded: Wholesale, hospitality, resale, and corporate/institutional buyers are excluded — only individual U.S. end consumers qualify. How much can you get?

The $9M fund is divided by total valid claims — e.g. 90,000 claims ≈ $100 each, 180,000 ≈ $50 each. You qualify even if you never had a contamination event.

  • Possible pro rata cash component

    If the court awards Class Counsel less than $3M in fees/costs, the difference is paid to class members as pro rata cash instead of reverting to the defendants.
