What is this settlement about?

Pawn America agreed to a $3,185,000 non-reversionary settlement (In re Pawn America Consumer Data Breach Litigation, District of Minnesota) over a September 2021 breach in which an unauthorized party accessed files containing names, Social Security numbers, driver's license and passport numbers, government IDs, dates of birth, and financial account information. The brand is operated by three related defendants that shared customer systems — Pawn America Minnesota (pawn shops), Payday America (short-term loans), and PAL Card (prepaid debit cards) — so customers of any of the three may be affected. Pawn America denies wrongdoing.

Who's excluded: Excluded are the presiding judge, Pawn America directors and officers, and anyone who validly opts out by June 5, 2026. Self-prepared documents alone aren't sufficient for the documented-loss tier.

How much can you get?

  • Classwide cash — $30 (+$50 California)

    $30 for any valid claim with your Claim ID & PIN — no further documentation. California residents (Sep/Oct 2021) add $50, for $80 total. Amounts may adjust pro rata by claim volume.

  • Documented losses — up to $5,000

    Reimbursement for documented out-of-pocket losses traceable to the breach (fraud charges, identity theft, professional fees, credit freeze/monitoring, postage/mileage). Requires third-party documentation; can be claimed on top of the cash payment.
