What is this settlement about?

Fandango agreed to a settlement (combined estimated benefits ~$9.4 million) of Jonathan Beer et al. v. Fandango Media, LLC in San Diego Superior Court. Named plaintiffs allege Fandango (1) failed to timely disclose a mandatory Convenience Fee on online movie-ticket purchases to California theaters, and (2) sold FanClub memberships whose $10 monthly credits expired after 30 days, allegedly violating California's Gift Card Law and related statutes. Fandango denies wrongdoing and is settling without admitting liability. The settlement has two classes with different windows and benefits; you can be in one, both, or neither, and benefits stack.

Who's excluded: The Convenience Fee class excludes consumers subject to binding arbitration with Fandango (most aren't). Vouchers can only be used on Fandango.com or the app (not at theater box offices), can't be combined with other discounts, and aren't transferable.

How much can you get?

  • Convenience Fee Class — $3.25 cash or voucher

Choose $3.25 cash (requires a claim form with the Unique ID + Confirmation Code from your email notice) OR a $3.25 Fandango voucher issued automatically (expires 3 years after issuance). Same amount — cash needs action, voucher is automatic.

  • FanClub Class — $7.50 voucher (automatic)

California/Washington FanClub members automatically get a $7.50 Fandango voucher (never expires) — no claim form, no cash alternative.

  • Both classes stack
