What is this settlement about?
On November 29, 2024, Krispy Kreme discovered that hackers had gained unauthorized access to its systems and obtained personal information — some combination of names, dates of birth, Social Security numbers, and financial account access information. Krispy Kreme agreed to pay $1,616,760 into a settlement fund to resolve the resulting class action. Krispy Kreme denied any wrongdoing and the court has not found that it violated the law; both sides settled to avoid the cost and risk of further litigation. The exposure of Social Security and financial account information is serious because it creates identity-theft and fraud risk that can persist for years.
Who's excluded: Limited to living U.S. residents who were sent a breach notice. Expenses already reimbursed by another source (including any credit monitoring Krispy Kreme offered in the original notice) cannot be claimed.
How much can you get?
No-proof cash — ~$75
An estimated $75 with no documentation (Class Member ID from your breach notice still required). The amount can rise or fall depending on how many people file.
Documented losses — up to $3,500
Reimbursement of up to $3,500 per person for fraud, identity theft, or out-of-pocket losses traceable to the breach, with documentation (bank statements, receipts, phone records). If documentation is inadequate, the claim is processed as the ~$75 no-proof payment.
